The premium way to travel to France

1.1 Your booking is only valid for the booked departure time and the vehicle type stated .

Failure to complete both the outward and return journeys in respect of a return booking will invalidate your booking and in the event that you complete only one journey in respect of a return booking, you will be liable to pay the difference between the price that you paid for your return booking and the single fare applicable at the time that your journey was made. Eurotunnel reserves the right to obtain from you payment in full for all sums so arising. All travel must be completed within 1 calendar year of the date of original purchase.

1.2 Amendable before day of travel

You can amend your booking in the same direction of travel prior to the day of booked travel subject to availability. Dependent on your fare type a charge may apply. (Please see table.) This charge will be the difference between the price you paid for the original booking and the price applicable to the new booking unless the amendment does not change the date and time slot of your original booking. All travel must be completed within 1 calendar year of the date of original purchase.

1.3 Check-In time

You must Check-In at least 30 minutes (but not more than 2 hours) before your booked departure time on both the outward and inward legs of your journey. If you check-in more than 2 hours before your booked departure time, you may be offered an earlier departure. A charge may apply.

1.4 Exchangeable on or after day of travel

If you arrive at Check-In after this time (see above) your booking is no longer valid. However it may be possible to exchange your booking in the same direction of travel for the next available departure at Check-in subject to the following conditions. A charge may apply.

Standard Tickets

• If you arrive within 2 hours of the booked departure time, the booking will be exchanged without charge ;
• If you arrive more than 2 hours but no more than 24 hours after the booked departure time, the booking will be exchanged if you pay any difference between the price you paid and the price applicable to the departure for which your booking is exchanged ;
• If you arrive more than 24 hours after the booked departure time, your booking will not be exchanged ;
• These tickets are not refundable and cannot give rise to any financial compensation claim.;
• All travel must be completed within 1 calendar year of the date of original purchase.

Short Stay Saver Tickets

• If you arrive within 2 hours of the booked departure time, the booking will be exchanged without charge ;
• If you arrive more than 2 hours but no more than 24 hours after the booked departure time on your outward journey, the booking will be exchanged if you pay any difference between the price you paid and the price applicable to the departure for which your booking is exchanged ;
• For bookings of up to 4 calendar days' duration : if you arrive more than 24 hours after the booked departure time on your return journey, your booking will not be exchanged ;
• For bookings of 5 calendar days' duration : if you return after midnight on the day of booked departure time on your return journey, your booking will not be exchanged.
• These tickets are not refundable and cannot give rise to any financial compensation claim.
• All travel must be completed within 1 calendar year of the date of original purchase.

Day/Overnight Tickets

• If you arrive within 2 hours of the booked departure time, the booking will be exchanged without charge ;
• If you arrive more than 2 hours but no more than 24 hours after the booked departure time on your outward journey, the booking will be exchanged if you pay any difference between the price you paid and the price applicable to the departure for which your booking is exchanged ;
• For booked return journeys on the same calendar day : if you return more than 2 hours but no more than 24 hours after the booked departure time on your outward journey, the booking will be exchanged if you pay any difference between the price you paid and the price applicable to the departure for which your booking is exchanged ;
• For bookings of 2 calendar days' duration : if you return after midnight on the second day of booked departure time, your return booking will not be exchanged.
• These tickets are not refundable and cannot give rise to any financial compensation claim.
• All travel must be completed within 1 calendar year of the date of original purchase.

Flexiplus Tickets

• Upon arrival you will be placed on the next available departure.
• Tickets are refundable up to 1 calendar year from the date of original purchase.
• All travel must be completed within 1 calendar year of the date of original purchase.

5 Day Flexiplus Tickets

• Upon arrival you will be placed on the next available departure.
• If you return after midnight on the 5th calendar day following your outward departure date, your return booking will not be exchanged.
• Tickets are refundable up to 1 calendar year from the date of original purchase (providing that both legs are unused).
• All travel must be completed within 1 calendar year of the date of original purchase.

Flexiplus Peak Day Charges

• Peak Day Charges are payable on busy days. The cost of charges varies depending on the date of travel. Charges will be added to the total cost of your ticket.
• Peak Day Charges are payable on tickets booked after 7th June 2017 through our website, contact centre or at check in.
• Passengers booking a non-peak day ticket, must pay the Peak Day Charge if travelling on a peak day.
• Passengers booking for a peak day who travel on a non-peak day will receive an automatic refund of the Peak Day Charge.

"Carriage" means the transport of Vehicles (including their Commercial Goods and/or Personal Belongings) and their Passengers on Shuttles via the Channel Tunnel.

"Channel Tunnel" means the Fixed Link as defined in the Treaty of Canterbury between the UK and France signed on 12th February 1986.

"Commercial Goods" means any articles, sample, tools, goods or materials for sale, re-sale, commercial delivery, transfer, or for incorporation into other commercial goods.

"Commercial Van" means any light goods vehicle with an actual weight up to 3.5 tons AGW, whose dimensions do not exceed 3.6 metres in height, 2.55 metres width.

"Commercial Vehicle" means any vehicle, other than a Passenger Vehicle, carrying Commercial Goods or designed/intended to do so, including, but not limited to, box vans, Commercial Vans, articulated vehicles, coaches, public service vehicles, lorries, tractor vehicles, and vehicles with trailers and semi-trailers.

"Competent Authority" means any person, national or international body or organisation with the power to make Regulations relating to the operation of the Channel Tunnel.

"Contract of Carriage" means these Conditions of Carriage, any other agreements or documentation issued by Eurotunnel relating to the Carriage, and the Ticket.

"Customer" means any person in whatever capacity who concludes a Contract of Carriage with Eurotunnel, who purchases or authorises the purchase of a Ticket, and/or who uses the Channel Tunnel including, as the context requires, the account holder, the person making the booking, the driver of a Vehicle, any Passenger(s), the person or business entity which operates, owns or charters the Vehicle, the freight forwarder, and/or any person or business entity with an interest in the Vehicle or Commercial Goods or Personal Belongings in or on a Vehicle.

"Dangerous Goods" means any product, substance, material, article or item, capable of posing a significant risk to health, safety, property or the environment and which is classified under the ADR Regulations or any other Regulation in force by either Eurotunnel or Competent Authorities and/or specific provisions included in international treaties, duly ratified by the UK and/or France.

"Eurotunnel" means the partnership between the Channel Tunnel Group Limited and France-Manche S.A. and their assignees acting as concessionaires and operators of the Channel Tunnel pursuant to a concession awarded by the UK and French Governments dated 14th March 1986.

"Force Majeure" means any state of affairs beyond the reasonable control of Eurotunnel, including without limitation, act of God, adverse weather conditions, fire, flood, riot, armed conflict, terrorist action, civil disturbance, unauthorised intrusions, action by Government or other Competent Authority, national emergency, any third party strike, lock-out or industrial dispute, or power or mechanical failure (howsoever arising).

"Passenger” means any person travelling in or with a Vehicle on a Shuttle, including drivers.

“Passenger Vehicle” means any motor vehicle, other than a Commercial Vehicle, not used, designed or intended for the carriage of Commercial Goods, and including but not limited to, cars, motorcycles, private vans, camper vans and any caravan or trailer attached to a Passenger Vehicle.

"Personal Belongings" means any article or thing that is not Commercial Goods and is intended for the personal use of Passengers whether in or on a Vehicle, or carried or worn, including but not limited to luggage and suitcases and their contents, and consumables used for purposes incidental to the Passenger’s work.

"Regulations"’ means these Conditions of Carriage, any laws, legislation, bylaws, customs regulations, rules, regulations, procedures, policies or guidance issued by any Competent Authority, including Eurotunnel, concerning Carriage via the Channel Tunnel.

"SDR" means Special Drawing Rights as defined from time-to-time by the International Monetary Fund.

"Shuttle" means the Eurotunnel rolling stock consisting of locomotives and carriages.

"Ticket" means the ticket, hanger or other form of authority to travel issued for Carriage on a Shuttle by Eurotunnel.

“Vehicle” means Commercial Vehicle and/or Passenger Vehicle, as the case may be.

Words expressing the singular include the plural and vice versa where the context requires.

2.1    These Conditions of Carriage apply to the Carriage of all Vehicles and their Passengers, Commercial Goods and Personal Belongings on Shuttles.

2.2    Carriage on Shuttles is subject to all applicable Regulations issued by Competent Authorities and all terms and conditions of sale to which any Ticket is subject. The Ticket is the evidence of the Contract of Carriage with the Customer. The Ticket is not a consignment note.

2.3    Commercial Vehicles are only permitted on freight Shuttles. Subject to availability and compliance with the particular terms and conditions relating to the Vehicle, Commercial Vans and coaches are permitted on passenger Shuttles. 

2.4    All warranties, terms and conditions not set out in these Conditions of Carriage whether implied by statute or otherwise are excluded to the fullest extent permitted by law. 

2.5    By making a booking or opening an account the Customer confirms and warrants that all Passengers and any person with an interest in the Vehicle, Commercial Goods, or Personal Belongings, have been notified of, have read and accepted, and shall comply with these Conditions of Carriage.  

3.1    Eurotunnel agrees to provide Carriage to Vehicles, their Passengers, their Commercial Goods and Personal Belongings on its Shuttles to their destination terminal via the Channel Tunnel subject to and in accordance with these Conditions of Carriage provided that:

    3.1.1     Carriage is permitted under the Regulations and not prevented by Force Majeure;

    3.1.2     Customers comply with these Conditions of Carriage;

    3.1.3     drivers accept liability for the embarkation and disembarkation of their Vehicle on to and from Shuttles; and

    3.1.4     Passengers do not act in a manner likely to endanger any person or property or pose a threat to Carriage.

3.2    Eurotunnel agrees to:

    3.2.1     provide Carriage with reasonable skill and care and in accordance with the Regulations;

    3.2.2     use reasonable endeavours to avoid causing any loss or damage to any Vehicle.

3.3    In the event that Carriage is delayed, suspended or cancelled for any reason whatsoever so that Carriage is not, in Eurotunnel’s sole opinion, possible within a reasonable time then Eurotunnel shall either, at its cost and in its sole discretion:

    3.3.1     make arrangements for the Customer to travel to or from Calais or Dover (as the case may be) with another operator of cross channel travel services; or

    3.3.2     cancel the Ticket and refund the fare paid by the Customer; or

    3.3.3     offer the Customer the opportunity to cancel their Ticket and re-book Carriage at a different time (but on the same tariff band). Customers rejecting this offer will receive a refund in accordance with condition 3.3.2.

3.4        In respect of delay, disruption or cancellation, Eurotunnel is only liable to the extent stated in conditions 3.3.1 to 3.3.3. The taking of any of the above steps by Eurotunnel shall be in full and final settlement of any claim any Customers may have against Eurotunnel.

3.5        Passengers failing to comply with the current Conditions of Carriage do so entirely at their own risk.

3.6        Eurotunnel shall not be liable for any delay nor any consequences arising from compliance with these Conditions of Carriage.

3.7                  Eurotunnel shall be entitled to refuse Carriage to a Customer who fails to comply with the terms of these Conditions of Carriage.

4.1    Customers must comply with all Regulations relating to safety and security in force from time to time, and available at www.eurotunnel.com.                      

4.2    Customers must ensure that:

    4.2.1     Vehicles are safe for Carriage and secure during Carriage;

    4.2.2     heaters, electrical units and devices and gas equipment are switched off and aerials are retracted;

    4.2.3     Vehicles, Commercial Goods and Personal Belongings are free from infestation of any description and from contamination from any cause whatever;

    4.2.4     Personal Belongings and Commercial Goods are properly loaded and secured;

    4.2.5     Passengers are fit to travel on a Shuttle;

    4.2.6     they take all reasonable steps not to impair the health and safety of other Passengers and Eurotunnel personnel on Eurotunnel’s terminals and Shuttles.

4.3     Passengers confirm that they have full knowledge of the contents of their Vehicle, any Commercial Goods and Personal Belongings.

4.4    Passengers shall:

    4.4.1     comply with any checks, inspections and searches of their person, Vehicles, Commercial Goods and Personal Belongings ;

    4.4.2     answer any questions and provide to Eurotunnel, Customs, Police or security personnel such information as they consider in their sole discretion to be necessary or desirable to ensure the safety, security,  efficiency and regular operation of Carriage;

4.4.3     comply with all Regulations and instructions given by Eurotunnel personnel.

5.1    Subject to condition 3.3.2, and applicable booking terms, Tickets are non-refundable.

6.1    The Carriage of Dangerous Goods, hazardous goods and hazardous articles, is subject to the provisions Eurotunnel’s policy for the Carriage of Dangerous Goods available at www.eurotunnel.com and www.eurotunnelfreight.com.

6.2    Exclusions and restrictions:

    6.2.1     on passenger Shuttles: the Carriage of Dangerous Goods is not permitted.  The Carriage of hazardous goods and hazardous articles is restricted.

    6.2.2     on freight Shuttles: the Carriage of Dangerous Goods is restricted and conditional upon prior declaration as described in the above-mentioned policy.  The Carriage of hazardous goods and hazardous articles is also restricted.

6.3    The Customer indemnifies Eurotunnel against:

    6.3.1     any loss or damage suffered by Eurotunnel;

    6.3.2     any liability which Eurotunnel may incur to any third party;

caused by the Customer’s failure to comply with Eurotunnel’s above-mentioned policy.

6.4     Eurotunnel shall have no liability to the Customer for any other Customer’s failure to comply with Eurotunnel’s above-mentioned policy.

7.1    The Carriage of animals is not permitted on freight Shuttles. Such Carriage is permitted on passengers Shuttles subject to Eurotunnel’s policy for the Carriage of animals available at www.eurotunnel.com and www.eurotunnelfreight.com.

8.1    Vehicles powered by LPG (or equivalent flammable gas) are not permitted on Shuttles.  Eurotunnel also reserves the right to exclude from Carriage, for such period as it shall in its sole discretion determine:

    8.1.1     Vehicles which fail to comply with the Regulations applicable to their vehicle category (including dimensions);

    8.1.2     Vehicles which in Eurotunnel’s sole opinion present a threat to the safety or security of any person or of the Channel Tunnel, or whose condition may cause delay, or otherwise impede Carriage; 

    8.1.3     Vehicles carrying Commercial Goods or Personal Belongings improperly or inadequately secured or packed; or which have failed any pre-boarding check or inspection;

    8.1.4     Passengers not in possession of a valid Ticket;

    8.1.5     Passengers not in possession of valid travel documents; whose travel documents are destroyed or defaced, expired, incomplete or fraudulent; or who refuse checks on travel documents;

    8.1.6     Passengers previously notified as barred from travelling with Eurotunnel;

    8.1.7    Passengers who appear to be intoxicated, under the influence of alcohol or drugs or whose conduct may, in Eurotunnel's sole opinion, present a risk to safety or security, or cause delay, or otherwise impede Carriage, or whose conduct is discourteous and/or likely to cause nuisance to others;

    8.1.8     Passengers who do not comply with the Regulations.

8.2    Smoking is strictly prohibited on board Shuttles. Smoking is only permitted in designated areas on Eurotunnel’s terminals. Eurotunnel may refuse Carriage to Passengers who violate this prohibition. 

8.3    For the avoidance of doubt Eurotunnel shall have no duty as bailor, and shall not be liable for storing, packing or unpacking of any Vehicles, Commercial Goods or Personal Belongings that have been checked, unloaded or excluded from Carriage.

9.1    Eurotunnel is not liable for any loss or damage, whatsoever and howsoever arising, to Vehicles, Commercial Goods and/or Personal Belongings unless such loss or damage arises directly from Eurotunnel’s breach of these Conditions of Carriage;

9.2    Eurotunnel also excludes its liability for any loss or damage arising:

    9.2.1     as a result of Eurotunnel exercising its rights under the Regulations, or the Customers’ failure to comply with these Regulations;

    9.2.2     subject to condition 3.3, from the delay, suspension or cancellation of Carriage, including situations which may lead to deterioration of Commercial Goods;

    9.2.3      from the assistance provided to Customers by Eurotunnel’s agents, employees or subcontractors and which arises from a failure of the Customer to comply with these Conditions of Carriage;

    9.2.4     from circumstances beyond its control including Force Majeure, the activities and/or negligence of third parties (including other Customers, border force and customs, police, tax and revenue authorities, and fire and rescue services), or any other activities which are not Eurotunnel’s responsibility and/or under its control;

    9.2.5     subject to condition 3.3, from a decision by Eurotunnel or any Competent Authority to suspend or to take steps to suspend access to the Channel Tunnel or Carriage whether in whole or in part;

    9.2.6     from the inherent risk of wastage in bulk or weight, latent defect or inherent defect, vice or natural deterioration of any Commercial Goods or Personal Belongings. Eurotunnel does not provide ancillary power for freezer units;

    9.2.7     from the carriage of money or other valuables;

    9.2.8     from breakdown recovery, the re-embarkation or re-packing of any Vehicle, Commercial Goods or Personal Belongings. The costs of recovery, re-embarkation or re-packing shall be payable by the Customer;

    9.2.9     from security and/or safety checks carried out by Eurotunnel or Competent Authorities;

    9.2.10  for any negligent acts or omissions of any third party on Eurotunnel’s terminals;

    9.2.11  for any fines or penalties imposed on the Customer by Competent Authorities;

    9.2.12  for claims for loss or damage not submitted in accordance with these Conditions of Carriage.

9.3    Eurotunnel is not liable, whether in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise in connection with these Conditions of Carriage for special or consequential loss or damage, whether direct or indirect, including loss of profit, loss of revenue, loss of use or loss of contracts, howsoever arising.

9.4    Subject to condition 10.1.1, Eurotunnel is not liable in connection with these Conditions of Carriage for any personal injury, death and/or loss or damage to Vehicles, Commercial Goods or Personal Belongings which:

    9.4.1     arises from any act or omission of the Customer; or

    9.4.2     is caused by events or circumstances unrelated to Carriage; or

    9.4.3     occurs at any time before a Shuttle departs from or after a Shuttle arrives at Eurotunnel’s terminals.

10.1     Nothing in these Conditions of Carriage excludes or limits Eurotunnel’s liability for:

    10.1.1     death or personal injury caused by Eurotunnel’s negligence;

    10.1.2     fraud or fraudulent misrepresentation by Eurotunnel; or

    10.1.3     any liability which cannot be legally excluded or limited and which directly arises out of or in connection with Carriage.

10.2     Eurotunnel's liability for loss or damage during and linked to Carriage shall be limited as follows:

    10.2.1     Eurotunnel’s liability for loss or damage to Commercial Goods shall in no event exceed: either (i) 8.33 SDR per kilogram gross weight lost or damaged (including packaging), or (ii) the purchase value of the Commercial Goods lost or damaged, or (iii) the depreciation in value of the Commercial Goods, whichever is lower.

    10.2.2     Eurotunnel’s liability for loss or damage to Personal Belongings shall be limited to 1,000 SDR per Vehicle.

    10.2.3     Eurotunnel's total liability for loss or damage in respect of a Commercial Vehicle (which in this context includes any Commercial Goods, Personal Belongings, and any towed vehicles or trailers whether loaded or empty), whether in contract or tort, and whatever the number of claims and/or claimants, shall not exceed 70,000 SDR per Vehicle.

    10.2.4     Eurotunnel’s total liability for loss or damage in respect of Passenger Vehicle (which in this context includes any Personal Belongings, and any towed vehicles or trailers whether loaded or empty), whether in contract or tort, and whatever the number of claims and/or claimants, shall not exceed 8,000 SDR per Vehicle.

10.3     Customers have a duty to use reasonable endeavours to mitigate any loss or damage allegedly suffered to their Vehicle, Commercial Goods and/or Personal Belongings.

10.4     Customers are liable for, and indemnify Eurotunnel against any breach of these Conditions of Carriage, any loss or damage to Eurotunnel’s property, and/or any loss or damage to third party property, caused by their Vehicle, Commercial Goods or Personal Belongings or by their failure to observe any Regulations while on Eurotunnel’s terminals or during Carriage.

11.1     Claims by the Customer for damage or loss during Carriage must be reported immediately to Eurotunnel’s personnel or within 3 business days by “signed for” letter following the date of Carriage (postal addresses available at www.eurotunnel.com – Contact us).

11.2     Claims submitted other than in accordance with condition 11.1 will not be considered by Eurotunnel.    

11.3     Any legal proceedings under these Conditions of Carriage must be brought within one year of the date of Carriage.

13.1     All parties to these Conditions of Carriage hereby irrevocably submit to the exclusive jurisdictions of the English and French courts as the case may be.

13.2     Subject to conditions 13.2.1 and 13.2.2 these Conditions of Carriage shall be governed by English law or French law:

    13.2.1     incidents occurring on a Shuttle prior to departure or after arrival shall be governed by the law and the courts of the country in which Shuttle is located;

    13.2.2     incidents occurring on a Shuttle that has commenced Carriage shall be governed by the law and the courts of the country of departure of the Shuttle.

13.3     In the case of death or personal injury these Conditions of Carriage shall be governed by the law and the courts of the country in which the incident causing the death or injury occurred.

13.4     For the avoidance of doubt, if English law applies then the English courts shall have exclusive jurisdiction. If French law applies then the French courts shall have exclusive jurisdiction. In case of legal actions brought in France by business Customers, jurisdiction is expressly awarded to the Commercial Court of Boulogne-Sur-Mer.

14.1     Eurotunnel shall have a lien on all or part of a Commercial Vehicle and/or Commercial Goods travelling on the Customer’s account, for all sums due to Eurotunnel from the Customer.

14.2     Eurotunnel shall give notice of the exercise of its lien to the Customer. If the sums due to Eurotunnel are not paid within 28 days from the date when Eurotunnel gives notice to the Customer then the Commercial Vehicle and/or Commercial Goods may be sold. Eurotunnel shall apply the proceeds of sale in satisfaction of the lien and all proper and related charges and expenses of Eurotunnel in exercising the lien. Eurotunnel will account to the Customer for any surplus.

15.1     No Waiver - No failure by Eurotunnel to enforce any provision of these Conditions of Carriage shall be construed as a waiver of such provision or affect Eurotunnel’s right to enforce any other provision.

15.2     Severance - Should any of the provisions of these Conditions of Carriage be determined to be void or unenforceable then the provision shall be severed and the remaining provisions shall continue in full force and effect. 

15.3     Variation - Eurotunnel reserves the right to amend these Conditions of Carriage at any time and without notice.  Any such amendment shall not be enforceable retrospectively. The Customer agrees that any use of the Shuttle implies acceptance of the applicable Conditions of Carriage. The current version of these Conditions of Carriage in force is available at www.eurotunnel.com.

15.4     Foot Passengers are not permitted on Shuttles.  Eurotunnel carries cyclists in accordance with its booking terms available at www.eurotunnel.com.

15.5     For Personal Belongings lost on the terminal or on a Shuttle contact customerservices@eurotunnel.com.

15.6     No Children under the age of 12 are permitted on freight Shuttles.

15.7     These Conditions of Carriage are issued in both English and French. Where the governing law is English, the English language version shall be treated as the authentic version, and where the governing law is French, the French language version shall be treated as the authentic version.

These Terms and Conditions apply to bookings for coach travel with Eurotunnel where travel occurs from 1 January 2015 and will continue to apply until they are amended by Eurotunnel. Booking and travel with Eurotunnel after the above date shall be deemed to constitute acceptance of these terms and conditions.

The following words and phrases shall have the following meanings:

• Account Application Form the form that must be completed in order for a Customer to open an account with Eurotunnel to make Bookings
• Agreement this agreement as may be amended from time to time
• Booking a booking issued by Eurotunnel for travel on a Shuttle by a Coach at the Published or Contract Fare
• Booked Departure the date and time of travel in relation to the Booking
• Booking Reference Number a unique reference number issued by Eurotunnel in respect of each Booking
• Channel Tunnel the Channel Tunnel as defined in the Treaty between the UK and France dated 12th February 1986
• Coach any passenger service vehicle designed for the carriage of 18 or more seated persons including drivers, the dimensions of which must not exceed:
  • Height 4.2 metres
  • Width 2.55 metres (plus mirrors)
  • Length 18.0 metres (including trailer)
  • Weight 24 tons
• Coach Calendar the annual coach calendar detailing Published Fares and tariff bands (green, yellow, red and black) and Fare Terms for coach travel, a copy of which can be obtained from the Coach Sales Centre email: coachsales@eurotunnel.com or the internet on www.eurotunnel.com
• Contract Fare the price for Bookings offered by Eurotunnel to the Customer from time to time
• Credit Account Holder the Customer whose details are specified on the Account Application Form and to which Eurotunnel has offered credit terms in respect of payment
• Customer a person or legal entity which makes a Booking
• Eurotunnel together The Channel Tunnel Group Limited and France-Manche S.A
• Fare Terms as detailed in the Coach Calendar or as indicated elsewhere
• Midi Coach a Coach of not more than 9.0 metres in length
• Package a trip originating in the UK or France comprising one-way or return Travel and another element (e.g. accommodation) approved by Eurotunnel
• Package Tour Agent (PTA) a Customer, as designated by Eurotunnel at Eurotunnel's sole discretion, which makes Bookings for the sole purpose of resale as part of Packages
• Passenger any person travelling in or with a Coach on a Shuttle other than the designated drivers of a Coach
• Published Fare as detailed in the Coach Calendar
• Shuttle a Eurotunnel shuttle train
• Standard Coach a Coach exceeding 9.0 metres in length
• Travel the transport on the Shuttle of a Coach and its Passengers

3.1 The Customer shall:-

3.1.1 comply with the terms of this Agreement without limitation. In the event of failure to comply with the terms of this Agreement, the Customer shall, in addition to any other Eurotunnel rights or remedies available to Eurotunnel, no longer be entitled to the Contract Fare and shall pay for Bookings at the Published Fare;

3.1.2 not disclose details of the Contract Fare to any third party without the prior written consent of Eurotunnel;

3.1.3 not permit the use of the Contract Fare by any other person save where the provisions of clause 3.2 apply; and

3.1.4 be fully liable for the actions of all its servants, agents and any other Coach operator who travels on the Customer's account. Eurotunnel reserves the right to claim financial compensation from the Customer for any loss caused by the Customer or any other Coach operator travelling on the Customer's account.

3.2 In respect of Customers which are PTAs, they shall:-

3.2.1 advertise the cost of a Package as a single, all-inclusive price thereby not identifying the
element of the Package which comprises the Contract Fare;

3.2.2 notify their customers of all Booking details and any provisions of this Agreement relating to them, and provide them with a copy of Eurotunnel's Conditions of Carriage and Ticket Terms;

3.2.3 indemnify Eurotunnel against any costs, loss, liability or expenses arising (whether directly or indirectly) from any failure to make the notification referred to in clause 3.2.3; and

3.2.4 not hold themselves out as representing Eurotunnel in any capacity other than as PTA unless otherwise agreed by Eurotunnel in writing.

3.3 The Booking Reference Number shall be quoted by the coach driver at Check-In. If the driver fails to quote the correct Booking Reference Number, the coach driver shall be required to make a new Booking at the then applicable Published Fare.

3.4 Coaches shall arrive at Check-In not less than 45 minutes (but not more than 2 hours) before their Booked Departure. Coaches must arrive in the boarding area at least 25 minutes before the allocated departure time.

3.5 The Customer shall notify the Coach Sales Centre at the time of making a Booking if there are any Passengers likely to travel who would face difficulty in exiting unassisted from the Coach or from the Channel Tunnel in the event of an emergency or for any other reason. Failure to disclose such information at the time of making the Booking may result in a delay or denied boarding. Eurotunnel shall have no liability to the Customer in respect of any delay or denied boarding arising from such failure to disclose the required information.

3.6 The Customer shall notify the Coach Sales Centre when making a Booking if a Coach will be carrying football supporters. The Customer shall supply a full passenger list no less than 48 hours prior to Booked Departure. Details of the match, including the date and venue are also required. Failure to disclose such information may result in the Booking becoming invalid.

4.1 A Booking is only valid for the Coach stated within the Booking details and for the Booked Departure.

4.2 Eurotunnel shall be entitled to treat any coach driver quoting a Booking Reference Number relating to any Booking made by the Customer under this Agreement as acting as an authorised agent of that Customer. The Customer agrees to be bound by any act or decisions made by the coach driver in relation to that Booking or in relation to any new Booking made by the coach driver.

4.3 Coaches which arrive early may (subject to availability) be able to travel on an earlier departure. As Published Fares and Contract Fares may differ according to the date and time of travel, an additional sum may be payable by the Customer, which will be the difference between the price originally paid and the price applicable to any new departure.

4.4 Coaches which arrive late (i.e. less than 45 minutes before the Booked Departure) will no longer be able to travel on the Booked Departure as the Booking will no longer be valid. In these circumstances, if the coach driver wishes to travel, a new Booking will have to be made at the relevant fare.

4.5 Eurotunnel reserves the right to inspect and search any Coach and examine, remove or repack or otherwise handle the contents of any part thereof if directed or requested to do so by HM Revenue & Customs or any other civil or military authority or if Eurotunnel, in its reasonable opinion and its sole discretion, considers it desirable to do so. Eurotunnel shall not be liable for any costs, loss, damage or non-delivery or delay arising out or otherwise in connection with such action, unless caused by the fault or negligence of Eurotunnel.

4.6 Eurotunnel reserves the right to request details of Passengers and upon receipt of that information may, at its entire discretion, refuse carriage on the Shuttle of such Passengers or any coach carrying such Passengers.

4.7 Customers shall inform Eurotunnel at the time of making their Booking of the likely presence of domestic pets on board the Coach. The carriage of pets is covered by the relevant clause(s) in the Conditions of Carriage. Declaring the presence of pets is mandatory and the responsibility for doing so rests with the Customer. Dogs, cats, and ferrets are required to be subject to controls prior to embarking for the United Kingdom. These controls are carried out by Eurotunnel and the supplement payable in respect of each animal shall be paid by the Customer at the time of making their Booking. There is no supplement payable in respect of guide dogs for blind persons or for assistance dogs accompanying their owner, subject to the production of documentation attesting to the dogs' status. The controls take place prior to check-in and Customers should allow sufficient extra time. Eurotunnel recommends that Customers contact DEFRA (www.defra.gov.uk) for all relevant information.

4.8 Eurotunnel shall not be liable in the event of delays to crossings arising from Customers' failure to comply with clause 4.7 above, nor shall it be liable for any other consequence of Customers' failures to comply with the Pets Scheme (as set out in the Conditions of Carriage).

4.9 Failure to comply with the requirements of clause 4.7 may result in the refusal of carriage to the Customer and the Passengers, in which case the Contract Fare shall not be refunded.

4.10 Eurotunnel reserves the right to refuse carriage on the Shuttle and/or terminate the account of the Credit Account Holder upon which travel is made if:

4.10.1 a Coach uses the lanes reserved for Flexiplus passengers unless directed to do so by an authorised member of Eurotunnel staff; or

4.10.2 a Coach driver sets down Passengers anywhere on Eurotunnel premises, in particular at the service station on the UK terminal, without the authorisation of Eurotunnel.

4.11 Vehicles fitted with LPG containers to power domestic services e.g. cooking, refrigeration, heating and water heaters are accepted as long as the containers are switched off, weigh no more than 47kg and are not more than 80% full. If the Customer's vehicle is fitted with such a container, the Customer must declare this at Check-In. LPG (Liquefied Petroleum Gas) and dual powered vehicles (i.e. vehicles fitted with an LPG tank as an alternative fuel) cannot be accepted for transport by Eurotunnel

4.12 General
4.12.1 Black tariff dates are booked as single legs only.

4.13 Specific to Standard Singles
4.13.1 Can be booked on the day of departure.
4.13.2 Valid for single leg journeys.
4.13.3 Valid in either direction.
4.13.4 A return fare is the sum of the outbound and inbound single fares.

4.14 Specific to a 1 & 2 Day return or 3 – 5 Day return fares
4.14.1 Must be booked at least 1 day in advance.
4.14.2 Valid outbound from Folkestone to Calais only.
4.14.3 Fares are calculated using the outbound departure date.
4.14.4 Return journeys exclude Black tariff dates
4.14.5 The return journey to commence before midnight on the last calendar day of the specific ticket type.

5.1 Payment shall be made using a previously approved credit card or cleared cheque or by bank transfer at least 37 days before the Booked Departure.

5.2 For Bookings made less than 37 days before the Booked Departure payment shall be made at the time of Booking.

5.3 Bookings will not be confirmed until Customers comply with relevant payment terms.

5.4 If payment is not received in accordance with clause 5.1, the Booking will automatically be cancelled.

6.1 Payment shall be made by bank transfer to an account specified by Eurotunnel or by such other method of payment as may be agreed with Eurotunnel. Invoices shall be paid no later than the thirtieth day of the month following the month during which the invoice was issued.

6.2 Eurotunnel may at its sole discretion, terminate a credit account by giving notice in writing. In such circumstances, all Bookings made by the Credit Account Holder will be cancelled, except where they have been paid for in full.

7.1 Eurotunnel will invoice a Credit Account Holder not more than 28 days before the Booked Departure or, in the case of Bookings made within 28 days of the Booked Departure, immediately.

7.2 The Credit Account Holder shall notify Eurotunnel in writing of any dispute in relation to any invoice within 14 days of the date of the invoice.

7.3 Interest on any unpaid amounts due from any Customer shall accrue on a daily basis at the rate of 4% above the base-lending rate of NatWest Bank plc from time to time.

8.1 Except where the Commercial Terms state otherwise the Customer may cancel or amend its Booking without charge in the following circumstances:

- 8.1.1 any booking other than a 1 & 2 Day Return booking not less than 35 days before the Booked Departure;
- 8.1.2 any 1 & 2 Day Return booking not less than 10 days before the Booked Departure.
- 8.1.3 Black tariff date Bookings are Non Refundable.

8.2 Unless cancelled or amended in accordance with this clause Bookings may not be cancelled or amended and a Customer shall remain liable for the Contract Fare even if the Customer does not travel.

8.3 Cancellation or amendment of any promotional fare bookings may be made in accordance with the fare terms applicable. Where a Customer cancels or amends a promotional fare booking contrary to any applicable fare terms, the Customer shall remain liable for the price of that promotional fare booking.

11.1 In addition to any other indemnities contained in this Agreement the Customer shall indemnify Eurotunnel against any costs, loss, liability or expenses (including such costs, loss, liability or expenses arising out of or in connection with claims made by third parties) arising (whether directly or indirectly) out of or otherwise in connection with:

11.1.1 a breach by the Customer of any terms of this Agreement;

11.1.2 any act or omission committed by the Customer outside the scope of its authority;

11.1.3 the theft, loss or fraudulent use of Booking Reference Numbers where such theft, loss or fraudulent use results from the Customer's lack of prudent care of the same. The Customer shall notify Eurotunnel immediately upon becoming aware of any such theft, loss or fraudulent use;

11.1.4 any breach by the Customer or its Passengers of the Eurotunnel Conditions of Carriage (provided that where the liability arises out of a breach by a Passenger the Customer's liability shall not exceed £1 million per any one occurrence);

11.1.5 any breakdown of a Coach whilst loaded on a Shuttle or occurring during loading or unloading;

11.1.6 any defects in, or inadequacy or overloading of a Coach;

11.1.7 any death or injury to any third party, including any Passenger, caused by the negligence of the Customer, its servants, its agents or any independent contractor;

11.1.8 the refusal of entry to the Channel Tunnel of any Passenger or whose entry is unlawful for any reason whatsoever.

11.2 Eurotunnel shall not be liable for any costs, loss, liability or expenses incurred by any Customer arising out of or otherwise in connection with:

11.2.1 any delay in the boarding of any Coach on a Shuttle, its exit from the Shuttle or in the Shuttle's passage through the Channel Tunnel; or

11.2.2 any interruption (for whatever reason) in the commercial operation of the Shuttle service for the transport of Coaches or, such service having commenced any interruption thereof for whatever reason.

12.1 Eurotunnel may terminate this Agreement immediately by written notice if the Customer:

12.1.1 fails to make payment of any amount falling due to be paid within 7 days of the due date for payment;

12.1.2 commits a material breach of any material obligation (other than a payment obligation) under this Agreement which it fails to remedy within 7 days of the receipt of the notice of such breach;

12.1.3 goes into liquidation, has a receiver or administrative receiver or similar official appointed over all or any of its assets or is subject to any proceedings in any relevant jurisdiction having a similar effect;

12.1.4 is declared insolvent or being an individual is declared bankrupt;

12.1.5 ceases or threatens to cease to carry on the whole or any material part of its business;

12.1.6 exceeds any credit limit as notified from time to time by Eurotunnel;

12.1.7 fails to utilise any credit account for a period of 3 months;

12.1.8 makes or attempts to make a reservation on behalf of a person not a party to this Agreement.

12.2 Either party may terminate this Agreement upon 30 days' written notice.

12.3 Upon termination of this Agreement the Customer shall immediately:

12.3.1 return to Eurotunnel all papers and materials supplied to the Customer by Eurotunnel;

12.3.2 remit to Eurotunnel all outstanding sums due to Eurotunnel.

12.4 Termination shall not affect Bookings which have been made and paid for prior to the date of termination.

12.5 Termination by Eurotunnel of this Agreement shall not release the Customer from any liability in respect of any rights accrued at the date of termination or in respect of any antecedent breaches of this Agreement.
